End User License Agreement

Draft updated: October 13, 2026. Effective when the Runny Bunny mobile application is publicly released. This draft should be reviewed by qualified counsel before submission.

This End User License Agreement (“Agreement”) is between you and Tindlo Inc. (“Tindlo”), not Apple Inc. or Google LLC. It governs your installation and use of the Runny Bunny mobile application (“App”). Tindlo is solely responsible for the App and its content, subject to the third-party podcast rights described below.

1. License grant

Tindlo grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the App on devices you own or control, solely for personal, non-commercial use and as permitted by the applicable app-store usage rules. On Apple devices, Family Sharing or volume purchasing may permit access by associated accounts where Apple’s rules allow it.

2. Restrictions

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, disassemble, attempt to derive source code from, bypass security controls in, or create derivative works of the App, except to the extent a restriction is prohibited by law or an open-source license expressly permits it. You may not remove proprietary notices or use automated means to manipulate rankings or interfere with the service.

3. Ownership

Tindlo and its licensors retain all rights in the App, including its software, interface, design, trademarks, and original materials. The App is licensed, not sold. Podcast audio, artwork, titles, descriptions, video, and publisher marks remain the property of their respective owners. This Agreement does not transfer any right in third-party podcast content.

4. Accounts and acceptable use

You are responsible for your account credentials and activity. Your use must comply with our Terms & Conditions, applicable law, and applicable third-party agreements, including your wireless data plan, podcast publisher terms, YouTube terms, Apple Media Services Terms, and Google Play terms.

5. Maintenance and support

Tindlo, not Apple or Google, is responsible for maintenance and support for the App as required by applicable law. Contact bunny@tindlo.com. Apple and Google have no obligation to provide maintenance or support.

6. Warranty

To the fullest extent permitted by law, the App is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, title, or non-infringement. If an Apple-distributed App fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation; Tindlo is responsible for other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to an applicable warranty.

7. Product and intellectual-property claims

Tindlo, not Apple or Google, is responsible for addressing claims relating to the App, including product-liability claims, legal or regulatory compliance claims, consumer-protection and privacy claims, and claims that the App or your use of it infringes a third party’s intellectual-property rights.

8. Legal compliance

You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as supporting terrorism, and that you are not listed on a U.S. Government prohibited or restricted-party list. You must comply with export-control, sanctions, and other laws applicable to your use.

9. Privacy

Information is handled as described in the Runny Bunny Privacy Policy. You can listen without an account. Optional account, synchronization, community, notification, and nearby-ranking features may process additional information as described there.

10. Suspension and termination

This license ends automatically if you materially violate this Agreement. Tindlo may suspend or terminate access for fraud, abuse, unlawful use, threats to security or service integrity, or repeated violations. When the Agreement ends, you must stop using and delete the App. Provisions concerning ownership, disclaimers, liability, and disputes survive.

11. Limitation of liability

To the fullest extent permitted by law, Tindlo will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages or for lost data, revenue, profits, goodwill, or opportunities. For any claim that cannot be excluded, Tindlo’s aggregate liability will not exceed the amount you paid to Tindlo for the App during the 12 months before the event giving rise to the claim. Mandatory consumer rights remain unaffected.

12. Apple third-party beneficiary

Apple and its subsidiaries are third-party beneficiaries of this Agreement for an App obtained through Apple’s App Store. When you accept this Agreement, Apple has the right to enforce it against you as a third-party beneficiary. No other third party receives enforcement rights unless applicable law requires otherwise.

13. Governing law

This Agreement is governed by Delaware law, without regard to conflict-of-law principles. State and federal courts located in Delaware have exclusive jurisdiction, except where mandatory consumer law permits a claim elsewhere.
